Tim has extensive experience in all aspects of commercial property and acts for both developers and investors on a wide range of matters including acquisition and financing of development sites, joint ventures (corporate and contractual), land options and “partnership” arrangements with housing associations. In addition he and his team handle substantial development schemes, including S106 planning agreements, environmental and planning considerations, rights of light and covenant issues.
Through his involvement in developments and investments Tim is experienced in all asset related matters including commercial lettings, sales of commercial investments, warranties and management agreements.
Recently, Tim has acted for major London developers in acquiring substantial developments sites, dealing with all post acquisition elements including S106 agreements, rights of light and infrastructure matters. As well as dealing with urban regeneration schemes, Tim is heavily involved in a number of strategic land sites outside London with a specialty in transportation hubs into London.
Mineral owner side I have acted for a substantial minerals owner during the last six years in protecting their assets against surface land developments, and including strategising defences of claims by surface owners intending to develop their surface land (declarations in the Chancery Division) and managing substantial trespass claims on their behalf and securing meaningful compensation by way of damages. I have also dealt with a number of successful settlements at mediation on mines and minerals matters.
My principal work has been to interpret from a contractual or title perspective the extent of the mineral ownership.
Surface owner side I have acted for various developers with risk analyses on development land subject to reservations of mines and minerals and the potential impact (ransom or otherwise) on those developments.
